Terms of Service

By approving an estimate, work order, or invoice, or by leaving your vehicle with us, you agree to these terms. In this document, "Altitude Speed," "we," and "us" mean Freedom Metal Works LTD, doing business as Altitude Speed and Fab. Questions or concerns: please call the shop at 303-469-1749. This number cannot receive text messages.

1. Authorization, Estimates and Additional Work

1.1Authorization to work. You authorize Altitude Speed to complete the services listed on your approved estimate or work order.
1.2Test drives. You authorize us to drive your vehicle on public roads for diagnosing, testing, and delivering it.
1.3Estimates. An estimate is a good-faith approximation based on what we know at drop-off. Estimates are valid for 30 days. Parts pricing and availability can change with our suppliers, and we will tell you before a change affects your total.
1.4Additional work. Hidden problems often appear once a vehicle is opened up. We will not perform work beyond your approved estimate without your approval. We will contact you by phone, text, or email, and your reply by any of those methods counts as approval. If we cannot reach you, we will pause the additional work, and your vehicle may incur storage fees under Section 3.
1.5Diagnostic and inspection fees. Diagnosis, inspection, and teardown time is billable at our shop labor rate, even if you decline the repair or the problem cannot be reproduced.
1.6Completion dates. Any completion date we give is an estimate. Parts delays, special-order items, supplier backorders, and custom fabrication can change timing, and we are not liable for delays outside our control.
1.7Your disclosures. You will tell us about known issues, prior repairs, aftermarket modifications, and tuning on the vehicle. You will remove valuables and personal items before drop-off and provide working keys, wheel-lock keys, and any codes we need.

2. Payment Terms

2.1Payment at pickup. You are responsible for paying the total cost of all completed services when you pick up your vehicle.
2.2Card fee. A 3% fee is added to all card transactions.
2.3Short-term (single-job) projects. We bill an initial deposit for all parts. Labor is billed when the job is complete.
2.4Long-term (multiple-job or multi-week) projects. We bill an initial deposit for parts. Labor is billed every Friday for the individual jobs completed that week.
2.5Special-order and custom parts. Deposits for special-order parts and custom-fabricated parts are non-refundable once the part is ordered or fabrication begins, because these items cannot be returned to the supplier or resold.
2.6Taxes. Sales tax and any applicable fees are added as required by law.
2.7Declined or returned payments. If a payment is declined or returned, you are responsible for any bank fees we incur, and we may hold your vehicle until the balance is paid.
2.8Past-due balances. Balances unpaid 30 days after the invoice date may accrue a late charge as permitted by law. You are responsible for reasonable collection costs, including attorney fees, on any past-due balance.

3. Vehicle Storage, Care and Liability

3.1Outdoor storage. We store vehicles outside at times. To the extent permitted by law, Altitude Speed is not responsible for theft or damage to your vehicle, including weather, hail, vandalism, or acts of third parties.
3.2Personal property. We are not responsible for personal items, electronics, tools, or accessories left in or on your vehicle.
3.3Insurance. You are responsible for keeping your vehicle insured. Your insurance is the primary coverage for loss or damage not caused by our negligence.
3.4Towing and delivery. If your vehicle is towed or delivered to us, you are responsible for those charges.
3.5Shop safety. For safety and insurance reasons, customers may not enter the shop work areas unless accompanied by a staff member.
3.6Pickup and storage fees. When we tell you your vehicle is ready, please pick it up within 3 business days. After that, a daily storage fee at our posted rate may apply. The same applies to vehicles left waiting for your approval, payment, or parts.
3.7Unclaimed vehicles and shop lien. As permitted by Colorado law, we may keep possession of your vehicle until all charges for authorized work, parts, and storage are paid. If a balance remains unpaid, we may pursue the lien and sale remedies available under Colorado law after giving the notice the law requires. If we cannot reach you, we will send notices to the contact information on your work order, so please keep it current.

4. Parts, Customer-Supplied Parts and Returns

4.1Parts we supply. We source parts from outside suppliers and manufacturers. Any manufacturer or supplier warranty on those parts passes through to you, and we will help you start a claim where we can.
4.2Aftermarket and modified parts. We do not offer any warranty or refund, express or implied, on modified or aftermarket parts, or on parts supplied by us. Only unmodified, stock parts are returnable for warranty, and final authorization is up to the parts supplier.
4.3Returns. Parts must be unused, uninstalled, and unmodified, in original packaging, and within the supplier's return window to be considered. Restocking and shipping fees charged by the supplier will be passed on to you. Electrical parts, special-order items, custom-fabricated parts, and tuned or programmed components cannot be returned.
4.4Customer-supplied parts. We may decline to install parts you bring in. If we install them, we do not warranty the parts or any resulting failure. If a customer-supplied part is incorrect, defective, or fails, you pay for the labor to remove, replace, and reinstall it, and for any related damage.
4.5Replaced parts. If you want your old parts back, tell us when you approve the estimate and we will keep them for you. Otherwise we dispose of them. Core charges are refunded only if the supplier accepts the core.
4.6Supplier and shipping delays. We are not responsible for back-orders, shipping damage, or delays caused by suppliers or carriers. We will let you know about delays as soon as we learn of them.

5. Warranty

5.1Street vehicles only. Warranty coverage applies only to work done on street vehicles. Any work done on vehicles that take part in any type of motorsports or off-roading is done without warranty coverage. A street vehicle that takes part in motorsports voids any warranty originally in place.
5.2Warranty period. Eligible workmanship is covered for 12 months or 12,000 miles, whichever comes first, from the date of pickup. The warranty covers our labor and assembly only. Parts are covered as described in Section 4.
5.3Engines. All rebuilt, performance, and crate engines are considered motorsports items and are treated that way throughout these terms. These engines carry a 30-day limited warranty on our assembly workmanship, starting at pickup, instead of the warranty period in 5.2. Any performance-application engine built for over 600 horsepower has no warranty.
5.4What is not covered. The owner pays for any failure caused by actions outside our control, including:
  • other people working on or inspecting the vehicle
  • manipulation of tuning data or the ECU
  • failure to follow the engine break-in procedure
  • running low on fluids
  • pre-existing problems, abuse, neglect, or accident damage
  • normal wear and consumable items such as brake pads, clutches, belts, fluids, and tires
5.5Contact us first. If a problem comes up, Altitude Speed should be the first to diagnose it. If anyone else works on or inspects the issue before we have the chance, we are no longer liable for any repairs or related costs.
5.6Our responsibility. If we are the first to inspect and the failure was caused by our assembly, we will warranty the repair.
5.7Making a claim. Call the shop at 303-469-1749, keep your original invoice, and bring the vehicle to us within a reasonable time after the problem appears. Continued driving after a warning sign can void coverage for the resulting damage.
5.8Limits of the warranty. Our remedy is to repair or redo the covered work. The warranty does not cover towing, rental vehicles, lost income, or loss of use. It is not transferable to a new owner.

6. Motorsports, Off-Road and Performance Disclaimer

6.1Intended use. Altitude Speed supplies parts that are designed and fabricated for motorsports and off-road use only. You use these products at your own risk.
6.2Nature of motorsports. Because of the nature of motorsports and off-roading, we cannot be held liable for product failures caused by unforeseen events or by improper use or abuse of products sold or installed by us.
6.3Effect on crash performance. Modifying a vehicle with parts sold by Altitude Speed can change how the vehicle performs in a crash and may result in property damage, bodily harm, or death. By purchasing from us, you assume full responsibility for any property damage or personal injury that may occur while using products sold by us.
6.4Part failures and installation. Altitude Speed is not responsible for personal injury or property damage arising from the failure of parts we sell. Do not purchase or install any part sold by us if you do not agree with these terms or do not feel competent to install and use it safely and correctly. Improper installation can cause personal injury, death, or property damage, and a qualified professional should install all products.
6.5Legality. Most products are intended for motorsports or off-road use and may not be legal where you live. Read your owner's manual and each product's instructions, and check all applicable laws before making these modifications. The owner and user are solely responsible for the legality and safety of any vehicle modified with these components.
6.6Emissions, inspections, insurance, and manufacturer warranty. Modifications can affect emissions compliance, inspection results, insurance coverage, and your manufacturer's warranty. You are responsible for understanding those effects before approving the work.
6.7Tuning and dyno testing. Tuning and dyno work runs a vehicle at high load and carries an inherent risk of mechanical failure, especially on engines with worn, damaged, or previously modified components. We take reasonable care, but we are not responsible for failures of parts that were already worn or defective, or for failures caused by pre-existing conditions we could not reasonably detect.

7. Limitation Of Liability and Disputes

7.1No consequential damages. In no event will Altitude Speed be liable for any incidental, consequential, or indirect damages, including loss of use, lost income, rental or towing costs, or lodging and travel expenses.
7.2Liability cap. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the specific work or part that gave rise to the claim.
7.3Rights that cannot be waived. Nothing in these terms limits any right you have under Colorado or federal law that cannot legally be waived.
7.4Resolve it with us first. If you are unhappy with our work, call the shop at 303-469-1749 and give us a chance to inspect and fix the problem before taking other action. We will work with you in good faith.
7.5Governing law and venue. Colorado law governs these terms. Any dispute that cannot be resolved directly will be brought in the courts of Weld County, Colorado.
7.6Changes to these terms. We may update these terms from time to time. The version in effect when you approve your estimate applies to that work.
7.7Entire agreement. These terms, together with your approved estimate, work order, and invoice, are the entire agreement between us. If they conflict, the approved estimate or work order controls on price and scope of work.
7.8Severability. If any part of these terms is found unenforceable, the rest stays in effect.

8. Acceptance

All customers approve this agreement, with full knowledge and understanding of this document, by doing work with Altitude Speed and Fab, by using our website, or by purchasing parts from us. By approving your estimate or work order, you confirm that you have read and agree to these terms.
